These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Student," "You") and KITE College (Khursheed Institute of Technology & Education) ("KITE College," "We," "Us," "Our"). By accessing our website, submitting an admission application, enrolling in courses, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accessing on behalf of a minor student, you represent that you are the parent or legal guardian and agree to these Terms on their behalf.

2. Eligibility and Admission

2.1 Academic Eligibility

Admission to KITE College programs is subject to meeting specific academic criteria as published in our admission policies. You must provide accurate and complete information during the admission process. Any false or misleading information may result in immediate rejection of application or dismissal from the program.

2.2 Age Requirements

3. Fees, Payments, and Refunds

3.1 Fee Structure

All tuition fees, registration fees, examination fees, and other charges are published in the official fee schedule. Fees are subject to change with prior notice. It is your responsibility to stay informed about current fee structures.

3.2 Payment Terms

Fees must be paid by the specified deadlines. Late payments may result in:

• Late fee penalties as specified in the fee policy
• Suspension of access to learning materials and portals
• Restriction from appearing in examinations
• Withholding of transcripts, certificates, or degrees
• Dismissal from the program

3.3 Refund Policy

Refund of fees is governed by our Refund Policy, which varies by program and timing of withdrawal:

• Within 7 days of enrollment: 80% refund (less processing fees)
• Within 15 days of enrollment: 50% refund
• After 15 days: No refund
• Examination fees and registration fees: Non-refundable

All refund requests must be submitted in writing to the admissions office. Processing time for refunds is 30-45 business days.

4. Academic Policies and Code of Conduct

4.1 Academic Integrity

KITE College maintains strict standards of academic integrity. The following constitute academic misconduct:

• Plagiarism (submitting others' work as your own)
• Cheating on examinations or assignments
• Falsification of academic records or documents
• Unauthorized collaboration on individual assignments
• Impersonation in examinations

Violations may result in grade penalties, course failure, suspension, or permanent expulsion.

4.2 Student Code of Conduct

All students must adhere to the KITE College Code of Conduct, which includes:

KITE College reserves the right to withhold credentials from students with unresolved obligations. Degrees are conferred based on the academic policies in effect at the time of enrollment.

7. Limitation of Liability

To the maximum extent permitted by law, KITE College and its affiliates, faculty, staff, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, including but not limited to:

• Loss of data, profits, or opportunities
• Personal injury or property damage
• Errors or omissions in course content
• Interruptions or delays in service
• Actions or conduct of other students or third parties

Our total liability shall not exceed the total fees paid by you to KITE College in the six months preceding the claim.

8. Disclaimer of Warranties

KITE College provides its Services "as is" and "as available" without any warranties, express or implied. We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• Any particular outcome or result will be achieved
• Employment or career advancement will result from our programs
• Course content is completely accurate or up-to-date

9. Termination and Suspension

Upon termination, you lose all access to student privileges, and fees are non-refundable.

KITE College reserves the right to modify these Terms at any time without prior individual notice. 12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to conflict of law principles.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of our Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Gujar Khan, Pakistan, in accordance with the rules of the Pakistan Arbitration Act. Judgment on the arbitration award may be entered in any court having jurisdiction.

12.3 Jurisdiction

For any matters not subject to arbitration, you agree to the exclusive jurisdiction of the courts located in Gujar Khan, Punjab, Pakistan.

13. Force Majeure

KITE College shall not be liable for any delay or failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, strikes, power outages, or internet service disruptions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any program-specific policies, constitute the entire agreement between you and KITE College regarding your use of our Services and supersede all prior agreements or communications.
